A Delhi court has ruled that a woman can withdraw her consent to divorce her husband even after the alimony amount has been settled by court. The judgement came after the dismissal of a man’s plea for eviction of his estranged wife and daughter from his house.
“It is only on the
continued mutual consent of the (two) parties that a decree of divorce can be passed by the court,” said additional sessions judge Surinder S Rathi.
The sessions court’s order came in a case involving a couple who were married in 1994 and have a 15-year-old daughter.
After their marriage fell apart, the woman approached a magisterial court for compensation and damages. The couple agreed to divorce each other on an alimony of Rs 44 lakh.
